Agreement to Terms
Welcome to Prime Dumpster Rentals. By using our website, requesting a quote, or renting equipment from us, you agree to these terms. If you don’t agree, please don’t use our site or services.
Services Overview
Prime provides roll-off dumpster rentals for homes, businesses, and job sites across Fort Smith and the River Valley. We also deliver bulk materials like gravel, mulch, and dirt. You can book online or call us to get started.
Service-Specific Terms
Dumpster Rental
- Rental period. Your rental covers an agreed number of days. Need more time? Let us know and we’ll work with you. Extra days may add to your cost.
- Placement. You’re responsible for choosing a safe, legal, and accessible spot, and for making sure the surface can support the weight of the dumpster and our truck.
- Permits. If your city or HOA requires a permit to place a dumpster on the street or public property, getting it is your responsibility unless we agree otherwise in writing.
- Weight limits. Each dumpster has a weight limit, and going over it may add charges. We’ll explain the limit before delivery.
- Prohibited items. For safety and legal reasons, do not place these in the dumpster: tires, hazardous materials, paint cans, pesticides, and gas or oil. Banned items in the load may add a fee. When in doubt, call us first.
- Overfilling. Keep all debris level with the top of the container. We can’t haul a dumpster loaded over the rails, and overloaded dumpsters may need to be leveled before pickup.
Material Delivery
We deliver gravel, mulch, dirt, and other bulk materials. You’re responsible for clear access and for telling us exactly where to place the load. Material quantities are estimates and can vary slightly.
Pricing & Payment
Quotes are estimates. Your final price is based on the actual service, dumpster size, weight, distance, and rental length. Extra charges may apply for overages, prohibited items, extended rentals, or deliveries beyond our standard service area.
Payment is due as agreed at the time of booking or service. We’ll go over accepted payment methods when you book.
Cancellation Policy
Plans change, and that’s okay. Please give us as much notice as you can if you need to cancel or reschedule. A fee may apply for canceled deliveries or for a truck that’s already on the way.
Liability & Indemnification
You agree to use our equipment safely and to follow these terms. You agree to cover any claims, damages, or costs that come from your use of our equipment, your failure to follow these terms, or items placed in the dumpster. We’ll do our part by delivering safe, well-maintained equipment and professional service.
Limitation of Liability
To the fullest extent allowed by law, our total responsibility for any claim is limited to the amount you paid for the service involved. We’re not responsible for indirect, incidental, or consequential damages, like lost time or lost business.
Property Protection
Driveway & Property Disclaimer
We take real care placing and removing every dumpster and protect your property whenever we can. Still, setting a heavy dumpster and truck on a driveway, lawn, or other surface carries some risk. When placement is at your direction, you accept that risk, and we aren’t responsible for damage to driveways, pavement, lawns, sprinkler systems, septic lines, or underground utilities. Please tell us about anything fragile or hidden before we arrive.
Website Use
Everything on this site, including text, logos, and images, belongs to Prime Dumpster Rentals or our partners. Please don’t copy, scrape, or reuse our content without permission. Don’t use the site in any way that’s unlawful or that could harm the site or other users.
Third-Party Links
Our site may link to other websites we don’t control, like a payment processor or map provider. We’re not responsible for their content or their privacy practices.
Dispute Resolution
These terms are governed by the laws of the State of Arkansas. If a dispute comes up, we’ll try to settle it directly first. If we can’t, you agree to resolve it through binding arbitration rather than in court, and to bring claims only on an individual basis and not as part of a class action, to the extent allowed by law.
Force Majeure
We’re not responsible for delays or problems caused by events beyond our control, like severe weather, road closures, accidents, equipment failure, or supply shortages.
Severability
If any part of these terms is found to be invalid, the rest stays in full effect.
